Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Percent, operated by Nadir Aktan as an independent developer ("Percent", "we", "us", "our"), and govern your access to and use of the Percent mobile application (the "App") and the website at percentgame.co (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. Eligibility — 18+ only

Percent is an adult service. You may use Percent only if you are at least 18 years old. This 18+ requirement applies to users worldwide, regardless of the age of majority or age of digital consent in your country. By creating an account or using the Service you represent and warrant that (a) you are at least 18 years old, (b) the date of birth you provided at signup is accurate, (c) you have the legal capacity to enter into these Terms, and (d) your use of the Service will comply with all applicable laws and regulations.

Providing a false date of birth in order to circumvent the 18+ requirement is a material breach of these Terms. If we discover that a user is under 18, we will terminate the account and delete the associated personal information as described in our Privacy Policy. Do not create an account or use Percent if you are under 18.

2. What Percent is

Percent is a real-time social prediction game. In each round you answer a yes-or-no question and then predict what percentage of the players in your room answered "yes". Three rounds make up a game, and your accuracy across those rounds updates your rating, streak, and rank. Additional features include friends, private invites, daily questions, session packs, and five progression tiers from Stranger to Mind Reader.

2.1 Bot-controlled players

To keep matchmaking fast, rooms may include bot-controlled players when there aren't enough humans immediately available. Bots participate in the gameplay but do not represent real users, and their presence can affect your rating. You may not always know whether a given room contains bots.

2.2 Service is provided as-is and may change

Percent is an independent project. Features, questions, rating formulas, matchmaking rules, bots, and pricing may change at any time. We may add, modify, or remove parts of the Service without notice. We do not guarantee that any specific feature, question, opponent, match outcome, rating, or score will remain available.

3. Your account

To use most of Percent you must create an account. You can sign up with an email and password, with Sign in with Apple, or with Google Sign-In. You are responsible for (a) keeping your credentials confidential, (b) any activity that happens under your account, and (c) ensuring that the information you provide during signup (including display name, username, and date of birth) is truthful and up to date.

Notify us immediately at nadir.aktan@hotmail.com if you believe your account has been accessed without your authorization.

4. Free and paid sessions

Percent provides a limited number of free sessions each day. Additional sessions can be purchased as session packs through the App Store. Free sessions are offered as a courtesy and may be changed, paused, or removed at our discretion.

4.1 In-app purchases

All in-app purchases are processed by Apple through the App Store and are subject to Apple's Media Services Terms and Conditions. Percent receives from Apple only the transaction identifier and product ID required to verify the purchase and grant you the sessions you bought. We do not receive your payment details.

4.2 Delivery of purchased sessions

Once Apple confirms your purchase, our back-end validates the transaction and adds the purchased sessions to your account balance. Delivery is usually immediate. If sessions do not appear within a few minutes, force-quit and reopen the app, then contact nadir.aktan@hotmail.com with your Apple receipt if the issue persists.

4.3 Refunds and restoring purchases

Refunds for in-app purchases are handled by Apple, not by Percent. To request a refund, visit reportaproblem.apple.com. If you buy session packs and then reinstall Percent on another device signed in with the same Apple ID, your existing sessions remain tied to your Percent account rather than your Apple ID. To recover sessions from a lost device, sign back into Percent with the same sign-in method you used originally.

4.4 No cash value and non-transferable

Session packs, ratings, tiers, achievements, streaks, and any other in-game items or progress have no monetary value, cannot be exchanged for cash, cannot be transferred between accounts, and are forfeited when an account is deleted or terminated.

5. Acceptable use

You agree not to, and not to permit anyone else to:

• Use the Service in a way that violates any applicable law, regulation, or third-party right (including intellectual property, privacy, and publicity rights).
• Harass, threaten, stalk, intimidate, bully, or harm any other user.
• Post, upload, or share profile content (display name, username, photo, bio, country, or any other field) that is illegal, obscene, hateful, discriminatory, sexually explicit, violent, defamatory, or otherwise inappropriate.
• Impersonate another person or misrepresent your affiliation with a person or entity.
• Cheat, exploit bugs, use automation, scripts, or any other means to manipulate matchmaking, ratings, streaks, achievements, friend invites, or session balances.
• Coordinate with other users to artificially inflate or deflate anyone's rating.
• Attempt to reverse engineer, decompile, disassemble, or otherwise extract the source code, algorithms, or training data of the Service, except to the extent such restriction is prohibited by law.
• Access or tamper with parts of the Service you are not authorized to access, including server infrastructure, Firestore collections, or Cloud Functions.
• Use the Service to collect personal data about other users, scrape content, or build a competing product.
• Upload or transmit any virus, malware, or other malicious code.
• Use the Service for commercial purposes (including advertising, promotion, sponsorship, or selling access) without our prior written consent.
• Circumvent any security, rate-limiting, or access control mechanism.

We may, at our sole discretion, investigate any suspected violation, remove content, suspend or terminate accounts, reset ratings or streaks, and cooperate with law enforcement, all without prior notice.

6. User content

"User Content" means anything you provide to the Service, including your display name, username, first and last name, date of birth, country, profession, education level, bio, and profile photo. You retain all rights you have in your User Content.

6.1 License you grant to us

By providing User Content, you grant Percent a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, adapt, and distribute that content solely to operate and provide the Service to you and other users. This license ends when you delete the specific content or your account, except to the extent the content has already been shared with others or is required to be retained for legal or back-up purposes.

6.2 Your representations

You represent and warrant that (a) you own or have the necessary rights in your User Content, (b) your User Content does not infringe the rights of any third party, and (c) your User Content complies with these Terms and applicable law.

6.3 No obligation to monitor

We do not have an obligation to screen or monitor User Content in advance, but we reserve the right to review, remove, or modify any User Content that we believe, in good faith, violates these Terms.

7. Reporting and blocking

If you encounter another user, a profile, a display name, or any content on Percent that you believe violates these Terms or is otherwise abusive, please report it to nadir.aktan@hotmail.com with the username, an approximate time, and a description of the issue. We aim to review reports and take appropriate action — including warnings, removal of offending content, temporary suspension, or permanent termination — within a reasonable timeframe.

We are working on in-app reporting and blocking controls. Until those ship, the email channel is the primary way to escalate abuse.

8. Game integrity and fair play

Percent depends on honest participation. We use automated and manual systems to detect cheating, rating manipulation, coordinated collusion, bot abuse, and other integrity violations. We reserve the right, at our sole discretion and without prior notice, to (a) reset a user's rating, tier, streak, achievements, or session balance; (b) roll back games or results affected by cheating; (c) suspend or terminate accounts; and (d) take any other action we consider necessary to maintain a fair and enjoyable game for everyone.

9. Intellectual property

The Service, including the Percent name, logo, icon, visual design, user interface, game mechanics, rating system, question content, written copy, source code, artwork, and all other materials (other than User Content), is owned by or licensed to Percent and is protected by copyright, trademark, and other intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial enjoyment. No other rights are granted.

10. Third-party services

The Service integrates with third-party services operated by Apple (Sign in with Apple, App Store, Apple Push Notification service) and Google (Firebase Authentication, Cloud Firestore, Cloud Functions, Cloud Storage, Cloud Messaging, Google Sign-In). Your use of those services is also subject to the applicable third-party terms and privacy policies. We are not responsible for third-party services, their availability, or their handling of data. Our Privacy Policy describes how we work with these providers.

11. Termination

11.1 Termination by you

You may stop using the Service at any time. You may delete your account directly from Settings → Delete Account in the App or via our delete account page. Deletion is permanent and cannot be undone.

11.2 Termination by us

We may suspend or terminate your account and your access to the Service at any time, with or without notice, if we reasonably believe that (a) you have violated these Terms or our Privacy Policy, (b) your use poses a security or legal risk, (c) your account has been inactive for a long period, or (d) we are required to do so by law. In serious cases we may terminate without notice and without refund.

11.3 Effect of termination

Upon termination, your right to use the Service ends immediately. Any sections of these Terms that, by their nature, should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Percent disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that (a) the Service will be uninterrupted, secure, or error-free; (b) defects will be corrected; (c) the Service or the servers that make it available are free of viruses or harmful components; (d) any content, question, match result, or rating is accurate or reliable; or (e) the Service will meet your requirements or expectations. You use the Service at your own risk.

13. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Percent, its operator, or any of its employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In no event will Percent's total cumulative liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid us in the twelve (12) months immediately before the event giving rise to the claim, or (b) fifty US dollars (US$50).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the limits above apply only to the maximum extent permitted by law, and nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or any other liability that cannot be limited by law.

14. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Percent and its operator from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your User Content, (b) your use or misuse of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right or applicable law.

15. Apple App Store additional terms

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Percent only, not with Apple. Apple is not responsible for the App or its content.
• Your license to use the App is limited to use on any Apple-branded device you own or control, and as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
• Any claims that the App or your possession and use of the App infringes a third party's intellectual property rights will be handled by Percent, not Apple, in accordance with these Terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Changes to the Service and to these Terms

We may add, modify, or remove parts of the Service at any time. We may also update these Terms from time to time. When we make material changes, we will update the "last updated" date at the top and, where we reasonably can, notify you through the App or the website. Your continued use of the Service after the updated Terms become effective means you accept them. If you do not agree to the updated Terms, stop using the Service and delete your account.

17. Governing law and dispute resolution

These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws of the country in which Percent's operator is resident, without regard to its conflict-of-laws principles. If you are a consumer, this choice of law does not override any mandatory protections of the consumer laws of your country of residence.

Before filing any formal claim, you agree to first contact us at nadir.aktan@hotmail.com with a written description of the dispute so we have an opportunity to resolve it informally. If we cannot resolve the dispute within 30 days, either party may pursue formal dispute resolution in the competent courts of the operator's country of residence, subject to any mandatory consumer rights.

18. General

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Percent regarding the Service and supersede any prior agreements.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice or consent.

Force majeure. We will not be liable for any delay or failure in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or network failures, or acts of any government.

No agency. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Percent.

Notices. Any notices to us should be sent to nadir.aktan@hotmail.com. We may send notices to you via the App, the email address associated with your account, or a prominent notice on the website.
